SC upholds Bihar competency test for teachers, rejects cancellation

Recently, the Supreme Court has struck down the petition that was personally brought by the teachers’ unions in Bihar to get the competency test nullified. The honorable apex court was very clear in saying that the teachers are the backbones of the nation, and if they cannot face these examinations, they should prefer to resign.

It is a wake-up call for the education system in Bihar, at least the private and independent ones that the top court has in its verdicts categorically stated this stern message. Disappointed with the state of education, the bench headed by Justice BV Nagarathna exclaimed, “Is this the level of education in the country?”

This writ has been filed by the non–profit organization called Parivartankari Prarambhik Sikshak Sangh against the Bihar Teacher Rules 2023.

As provided by the rules, newly appointed teachers of the state will only be recognized as state officials, hence entitled to all state provisions and support, after showing their competency in a test to be set.

At the same time, the Bihar government noted that taking the computer-based examination is not compulsory and that the non-taking of the test by teachers will not lead to termination of their services. Rather, those who pass the exam will become equal to state teachers and receive the corresponding facilities.

The Supreme Court’s strict stand on the competency test illustrates that it is high time to carry out rational and correct alterations for the improved organization of the educational system. As the state government continues to implement its plans, it is pertinent that equal consideration is given to teachers by giving them the tools and backing to help educate the students.
