Bombay HC seeks police reply on pleas by Mihir Shah and driver in BMW hit-and-run case

BMW hit-and-run case accused moves Bombay High Court.

The Bombay High Court has sought a response from the police on petitions filed by Mihir Shah and Rajrishi Bidawat, accused in the BMW hit-and-run case in Mumbai.

Shah and Bidawat, through habeas corpus pleas, have claimed their detention is illegal and sought immediate release. They are presently in judicial custody.

The court directed the police to file a reply affidavit by August 29. Shah has alleged the police remand and subsequent judicial custody orders passed by a local court violated the law.

Shah and Bidawat, the driver, were arrested in July for a hit-and-run incident where Shah’s BMW car allegedly mowed down a two-wheeler in Worli, killing 45-year-old Kaveri Nakhwa and injuring her husband.

It is alleged that Shah, who was under the influence of alcohol, fled the scene after the accident with Nakhwa remaining stuck to the car for over 1.5 km. While Shah’s father Rajesh Shah was granted bail, Mihir Shah and Bidawat have remained in custody.

Through the pleas, they have now approached the High Court challenging the legality of their arrests. The court will examine the matter further on August 29 after receiving the police’s response.
