Calling husband ‘eunuch’ mental cruelty, grounds for divorce: Court

The couple got married in December 2017. The husband, who sought a divorce, alleged that his wife was a “late riser.”

Chandigarh: Punjab and Haryana High Court held today that referring to a husband as “hijra” (eunuch) is an act of mental cruelty and upheld the divorce granted by a family court in favor of the man.

The division bench of Justice Sudhir Singh and Justice Jasjit Singh Bedi was hearing the plea of a woman against the divorce granted in favor of her husband by the family court in July this year.

If the findings recorded by the family court are confronted with the judgments of the Supreme Court, the acts and conduct of the appellant-wife amount to cruelty observed by the high court’s division bench.

Firstly, terming the respondent-husband as hijra and calling his mother to have given birth to a eunuch is an act of mental cruelty,” it added.

The order stated that considering the appellant’s wife’s overall acts and conduct and the parties’ living separately for the last six years, the learned family court rightly found that the marriage between the parties had ruptured beyond repair and had become dead wood.

The couple married in December 2017. The husband, who had filed for divorce, had complained that his wife was a “late riser.”

She requested his mother to send her lunch in the bedroom on the first floor and called her upstairs 4 to 5 times a day, ignoring that his mother had arthritis.

He alleged in his plea that his wife was addicted to watching porn and used to taunt him for not being “physically fit” and wanted to marry some other person.
