Delhi HC stays Kejriwal’s bail, hears ED’s challenge

One of the largest stories people read today was of the HC Delhi halting a trial court bail granted to Delhi Chief Minister Arvind Kejriwal on Friday. This followed a decision by the Enforcement Directorate (ED) to move the court to quash the bail order given to Sharifs.

Justice Sudhir Kumar Jain, who formed the vacation bench, said it may take two to three days for the court to pronounce its order on the ED stay application. As for the interim, the court has ordered the parties to submit their written submissions by Monday.

The court has also framed a notice in the stay application of the ED and the alleged plea in the next trial trench against the bail of the Aam Aadmi Party convenor.

This led to the trial court coming up with a one-sided verdict while the matter was considered, in the absence of the documents The ED’s counsel, SV Raju, criticized the trial court for reaching an sided decision while the matter was decided without going through the documents which were considered irrelevant for trial.

In turn, Kejriwal’s counsel, Abhishek Manu Singhvi, omitted the charges made by the ED in the high court. Singhvi said that he felt it was deplorable, saying that it should never come from a government authority and that the ED could have done better. He countered by accusing the ED of having its own “meaning of perversity” and claiming that there was a plan to bypass legal provisions.

Singhvi, for the petitioners, further submitted that the liberty of the individual is very, very low, if at all it exists in the mind of the ED. The ED was noted to be taking advantage of the typographical errors in the order of the trial court.

The AAP government and central investigating agencies have a long-standing complex relationship and this high-profile case has once again reignited this factor.

The decision of the Delhi High Court will be keenly awaited because it may avoid, throwing a new challenge for Kejriwal and his party in the current political scenario.
