The Delhi High Court has issued a summons to one of the Gurugram-based companies, Tesla Power India Private Limited after a case regarding trademark infringement and unfair trade practices had been filed against the company by Tesla Inc., owned by the famous entrepreneur Elon Musk.
The multinational behemoth, Tesla Inc., filed a lawsuit in the Delhi High Court against Tesla Power India when the latter announced its imminent entry into the EV market under the name TESLA. Tesla Inc. told the court that the newspaper had seen the Tamil Nadu telematics company making such – an announcement.
As informed by Tesla, the cease and desist orders were sent in April 2022 to Tesla Power India and Tesla Power USA, respectively, according to stated official company records. Nevertheless, Tesla (the trademark holder) and the defending company (the trademark infringer) could not reach a deal.
However, on 3/5/2023, the communication between the parties continued until somebody (either Tesla or the defending company) submitted a cease-and-desist order.
The next hearing was scheduled for May 2nd, and Justice Anish Dayal was going to hear the case. The Tesla Power India cracker pointed out in the court that he will not make or produce electric vehicles at present.
This aligns with his strategy of avoiding ads and striking deals on other EVs using custom name tags like ‘TESLA POWER USA’ or a name resembling ‘TESLA.’The court directed that Tesla Power India and its directors or any related parties take action within three weeks. A hearing is scheduled for May 22.
