Fresh PIL threatens Arvind Kejriwal’s Chief Minister post amidst controversy

The remand of Arvind Kejriwal, the national convenor of the Aam Aadmi Party, in the Enforcement Directorate, has ignited a fresh round of debate. A new PIL of Public Interest (PIL) has been dropped just as he is on the path to becoming the Chief Minister again. Hindu Sena, a political party, filed a petition to the Delhi High Court, ordering the suspension of Kejriwal from the CM of Delhi position.

To realize their aim, the suit calls on the Delhi lieutenant governor, VK Saxena, to throw Kejriwal out until the next elections. Additionally, the main issue of the petition is the declared state of emergency under the Lieutenant Governor’s rule.

The latest turn of events has seen the Delhi High Court reject a PIL intended to remove Arvind Kejriwal from his position as the Chief Minister of Delhi NCR. The court said that the court’s role was limited in disputes of this nature.

The judicial process still being held may not be able to deter the high levels of opposition against Kejriwal and his colleagues who insist on going about their business while in custody. As an added measure, they have already released it, as they made it this week.

The constitutional point will be mentioned as the latest PIL of Vishnu Gupta, President of Hindu Sena, has been filed. This query challenges the feasibility of the Chief Minister functioning as the head of the State government while in the custody of the Judiciary or Police, even in the event of his/her arrest.

The petition contends that such liminal positions are not contemplated under Articles 163 and 164 of the Constitution of India. These articles define the role and power of a state’s Chief Minister and Governor. Kejriwal’s arrest on March 21 is the main issue on which this claim is based. The Delhi government’s operations have been abnormal, and its workings have not followed the constitutional framework.

On the other hand, the speculation of the BJP party regarding Delhi’s successor is another factor. Along with this development, Bhartiya Janta Party members feel that maybe Sunita Kejriwal will replace her husband as the Chief Minister.

Drawing comparisons to Rabri Devi, the former Chief Minister of Bihar, Union Minister Hardeep Singh Puri insinuated that Sunita Kejriwal might be preparing to take charge.

In response, Sunita Kejriwal has launched a WhatsApp campaign urging people to support her husband during this challenging time. The political landscape remains tense as legal proceedings and speculation continue to unfold.
