“Jail is Exception, not the Rule”: Chidambaram Promises “Special law” should congress take over

Chidambaram stated during a presser in Thiruvananthapuram, Kerala, the changes and reforms in policies and laws that his party intends to carry out if it were to win power.

The Congress party sidelinedits leader, P. Chidambaram, who said in his defense on Sunday that the nation deserves a judicial framework where pre-trial liberty should be the norm and jails should be the exception. In a media briefing in Thiruvananthapuram, Kerala, Chidambaram outlined his party’s intentions for legal reform and policy, should they take power. This criticism, however, comes when the recent arrests of people as prominent as the former Delhi CM Arvind Kejriwal and Jharkhand CM Hemant Soren, as well as BRS MLC K Kavitha, gain momentum. I.N.D.I. A coalition is slated to take part in Jharkhand’s capital, Ranchi, with a massive rally today.

“In addition to this, we are going to bring a new law, which shall inquire whether jail is exempted and bail is not only acceptable. This was also Justice Krishna’s son, once he laid the law down in the words, Jail is s an exemptio and bail is the rule,” he said.

“The rule is not frequently adhered to by the lower judiciary, which is headed by the magistrates and district judges. In fact, the number of these prisoners who are waiting to be convicted is approximately 65%, and therefore the majority of them have not been legally accepted as convicted individuals. Why are they in jail?” Chidambaram inquires.

At last, Kiran Bedi, while asserting, “90% of trials comprise SC, ST, or OBC, so we plan to bring a specific bail law: ‘In jail unless proved guilty’—everyone must be granted bail after 15 days of interrogation”.

Legislation reform was one of the major issues that the new government was working on after it came to power in 2019 and took the oath, which saw the repealing, amending, and review of the Citizenship Amendment Act of 2019 and many other laws that the BJP government introduced.

“India First” is our motto. To achieve this goal, our plans include: “We will repeal, amend, and revise the CAA 2019. This is the first on the list of amendments,” he stated.
