Mihir Shah seeks release in BMW hit-and-run case

Accused in BMW hit-and-run case, Mihir Shah moves Bombay High Court; says he was held in unlawful custody and wants an immediate discharge. Shah was arrested on July 9, barely two days after he reportedly mowed down a two-wheeler in Mumbai’s Worli area, killing 45-year-old Kaveri Nakhwa and critically wounding her husband, Pradeep.

Shah filed a habeas corpus last week, arguing that his incarceration was unlawful and demanding that he be set free immediately. A division bench will likely comprise Justices Bharati Dangre and Manjusha Deshpande and hear the plea on Wednesday.

The 24-year-old Shah is said to have escaped the scene towards the Bandra Worli Sea Link, with the victim on the car’s bonnet, being dragged for over 1. Five-kilometer distance away from the point of the accident. According to police blots, Shah was found to be under the influence of alcohol when the incident occurred.

Other arrestees included former Shiv Sena functionary Rajesh Shah—Shah’s father–and the former’s driver, Rajrishi Bidawat. Although Rajesh Shah has been released on bail, Mihir Shah and Bidawat are now detained in judicial custody.
