The government-appointed board overseeing the completion of the Unitech housing projects has approached the Supreme Court against the Noida Authority’s decision to sanction individual units instead of the entire project. It called this a violation of an April court order.
“It is beyond logical comprehension as to how permissions can be given for individual units when the project must be developed as an integrated township in its totality,” the board said in its application before a Chief Justice of India Dhananjay Y Chandrachud-led bench.
In its application, which has yet to be heard, the authority acted on its whims and fancies and went against a specific court direction.
It observed that in April, the court had directed the authority to provide “project-wise approval.” The board felt that instead of recourse to the concept of “launched projects,” the authority was insisting on number-based approvals and then arriving at the net number of units requiring sanction by excluding units for which a refund is sought.
Granting such approvals is impractical, which merely shows the highhandedness and adamant attitude of Noida officials, who do not even comply with numerous specific orders passed by the Supreme Court.
The board says it may even face difficulty getting Real Estate Regulatory Authority approval as 70% of sale proceeds collected by the erstwhile management of Unitech are no longer available to it.
