ICJ demands Israel halt deadly Gaza offensive, but enforcement uncertain

This is after the International Court of Justice, the highest UN legal tribunal, declared the attacks and destructions in the raids as unlawful and asked Israel to stop the operations in the southern Gaza city of Rafah. The verdict was reached during the current fighting in this area, which has serious consequences for the Palestinians.

While addressing the humanitarian crisis in Rafah, the current president of the International Court of Justice, Nawaf Salam, said that the situation can be disastrous and requires serious and urgent action.

This ruling follows the earlier provisional orders given back in March, which were affiliated to be inadequate to adequately avert the worsening plight in Gaza.

This case is instituted by South Africa, which claimed that Israel is engaging in actions that could result in its physical destruction of the Palestinians in Gaza. The treaty in effect, the Genocide Convention to which Israel and South Africa are both signatories, …

Nations participating in the treaty must perform according to their agreement, thus enabling states that may not have any relation with a particular case of genocide to prosecute the case in court.

In the verdict, Salam said that Israel must “cease military operations in the Rafah Governorate and any other action that may endanger the lives of members of the Palestinian Group in the Gaza Strip to a point where the remaining or annihilated in whole or in part .”

The ruling is to address the deepening humanitarian situation in Rafah, where more than 35,000 Palestinians have died, as attested by the Gaza The merciless attack resulted in the destruction of the neighborhoods, forced evacuation from the homes of hundreds of thousands of people, and raised a level of famine all over the areas of Gaza strip.

The question arises, nevertheless, as to how much influence this ICJ decision can provide and whether it is feasible to have such a decision put a stop to the killings in West Asia. A notable drawback of the ICJ system is the ability and willingness to enforce the rulings since there have been instances when some countries have ignored the court’s decisions

. The global society will have to pay attention to whether this ruling will be able to make a change or not regarding the people in Gaza – Palestinians.
