Trump seeks to overturn hush-money conviction after immunity ruling

This came as a shock, especially to lawyers who had represented Donald Trump when he requested a New York judge to overturn his conviction in a hush money criminal case and defer sentencing following the recent Supreme Court ruling that granted him immunity to the prosecution of any official actions that he undertook during the presidency.

The letter, addressed to Judge Juan Merchan, who presides over the case, apparently maintains that Monday’s Supreme Court ruling corroborates the defense’s understanding that some prosecution witnesses’ statements should not have been admitted as evidence because they amounted to official presidential acts.

In May, Trump was convicted of 34 counts of providing false business records; the witnesses of the case included Stormy Daniels – the porn star with whom the former president was accused of having extramarital relations.

Prosecutors had said that Trump violated the election law through the approval of a plan to conceal a payment for the acquisition of silence Daniels during a campaign that was personal to him.

Nonetheless, many legal scholars think that the Supreme Court convicts are irrelevant to Trump since the case in New York seems to involve unofficial misconduct by the president.

Mark Zauderer, a New York appellate lawyer, remarked that Trump’s activities indicted in the New York fraud case bear the aspects of official misconduct by Trump, and none of the activities was connected to his official functions.

The former president, who has termed the verdict disgraceful, will be sentenced on July 11th. His lawyers’ recent action is considered the final attempt to turn the tables on conviction, but legal pundits opine that such attempts are not likely to be successful.
